These Terms of Service govern access to and use of www.thetephra.com (the “Website”) and purchases made through the Website.
The Website is operated by TEPHRA E.E., trading as TEPHRA (“TEPHRA”, “we”, “us” or “our”).
By accessing or using the Website, you agree to comply with these Terms of Service. Purchases made through the Website are additionally subject to our Return and Refund Policy, Shipping Policy and Privacy Policy.
Nothing in these Terms excludes, restricts or waives any mandatory right granted to consumers under applicable Greek or European Union law.
The authoritative language of these Terms is English.

TEPHRA E.E. is the seller for purchases concluded through the Website unless expressly stated otherwise.
USE OF THE WEBSITE
You may use the Website only for lawful purposes and in accordance with these Terms.
You must not misuse the Website, interfere with its operation or security, introduce malicious software, attempt unauthorised access, collect information through unauthorised automated means, or use the Website in any manner that violates applicable law or the rights of TEPHRA or any third party.
TEPHRA may restrict or suspend access where reasonably necessary to protect the Website, our customers, our business or third parties.
CUSTOMER INFORMATION AND ACCOUNTS
You are responsible for ensuring that information provided when placing an order, creating an account or communicating with us is accurate, complete and current.
Where an account is created, you are responsible for maintaining the confidentiality of your account credentials and for activity carried out through your account, except where applicable law provides otherwise.
Please notify us promptly if you become aware of unauthorised use of your account.
PRODUCTS
TEPHRA takes reasonable care to describe and display products accurately.
Colours and other visual characteristics may appear differently depending on the device, display settings or technology used to view the Website.
Handmade, treated, washed, dyed, distressed or individually finished products may present minor variations resulting from their materials, manufacturing or finishing processes. Such variations do not necessarily constitute a defect or lack of conformity.
Nothing in this section limits statutory rights concerning goods that do not conform to the sales contract.
PRODUCT AVAILABILITY
All products are subject to availability.
Adding an item to a shopping cart does not reserve that item.
In exceptional circumstances, a product may become unavailable after an order has been submitted because of simultaneous purchases, inventory discrepancies, damage discovered during preparation or another genuine stock issue.
Where we cannot supply an ordered product, we will inform you and refund any amount paid for the unavailable product without undue delay.
PRICES
Prices displayed on the Website are shown in the applicable currency and include VAT where required by applicable law.
Delivery costs and any other charges payable to TEPHRA will be disclosed during checkout before the order is submitted.
For deliveries outside the European Union, customs duties, import taxes, brokerage fees, customs-clearance charges or other charges imposed in the destination country may apply unless expressly stated otherwise during checkout.
Where such charges are not collected by TEPHRA as part of the transaction, they are the responsibility of the recipient.
PRICING, DESCRIPTION AND TECHNICAL ERRORS
TEPHRA takes reasonable care to ensure that prices, product descriptions and other information displayed on the Website are accurate.
If an obvious pricing, description, technical or system error occurs, TEPHRA may contact you before accepting or fulfilling the affected order.
Where an order cannot reasonably be fulfilled because of an obvious error, TEPHRA may cancel the affected item or order and refund all amounts paid in respect of it.
Nothing in this section affects any rights granted by mandatory applicable law.
PROMOTIONS AND DISCOUNT CODES
Promotional offers and discount codes may be subject to specific conditions, validity periods, product exclusions, minimum purchase requirements or other restrictions communicated with the relevant promotion.
Unless expressly stated otherwise, promotional codes cannot be combined.
TEPHRA may refuse or cancel the use of a promotional code where it has expired, does not satisfy its stated conditions, has been obtained or used fraudulently, or has been applied as a result of an obvious technical error.
ORDER PROCESS AND CONTRACT FORMATION
Submitting an order constitutes an offer to purchase the selected products.
An automated order acknowledgement confirms that we have received your order. It does not necessarily constitute final acceptance where verification of payment, stock availability, pricing or fraud-prevention checks remains necessary.
The sales contract is concluded when TEPHRA accepts the order, including by confirming dispatch or otherwise expressly confirming acceptance.
If TEPHRA cannot accept an order, we will inform you and refund any amount already charged in relation to the order.
RIGHT TO REFUSE OR CANCEL AN ORDER
TEPHRA may refuse or cancel an order where there is a legitimate reason to do so, including product unavailability, an obvious pricing or product-information error, payment failure or inability to verify payment, reasonable suspicion of fraud or unauthorised payment, misuse of promotional offers, a delivery destination that we do not serve, or another circumstance that makes fulfilment unlawful or objectively impossible.
Where an order is cancelled by TEPHRA after payment has been collected, all amounts paid to TEPHRA for the cancelled item or order will be refunded.
Nothing in this provision permits cancellation on grounds prohibited by applicable law.
PAYMENT
Available payment methods are displayed during checkout.
Payment may be processed by Shopify, banks or independent payment service providers.
By submitting payment information, you confirm that you are authorised to use the payment method provided for the transaction.
Additional authentication or verification may be required by your bank, card issuer or payment provider.
DELIVERY
Available delivery methods, applicable charges and estimated delivery information are displayed during checkout where available.
TEPHRA will deliver goods without undue delay and within any delivery period expressly agreed with the customer. Where no different delivery period has been agreed, delivery will take place within the period required by applicable consumer law.
Delivery estimates may be affected by circumstances outside our reasonable control. Any mandatory consumer rights concerning delayed delivery remain unaffected.
Customers are responsible for providing complete and accurate delivery information.
Where incorrect or incomplete delivery information supplied by the customer results in failed delivery, return to sender or the need for re-dispatch, the customer may be responsible for reasonable additional costs actually incurred as a result, where permitted by applicable law.

RISK OF LOSS OR DAMAGE
For consumer purchases, the risk of loss or damage to the goods remains with TEPHRA until the customer, or a third party designated by the customer other than the carrier, acquires physical possession of the goods.
Where the customer independently commissions a carrier that was not offered by TEPHRA, the transfer of risk will be determined in accordance with applicable law.
Nothing in these Terms transfers to the customer any risk that mandatory consumer law places on TEPHRA.
RIGHT OF WITHDRAWAL
Consumers purchasing eligible goods through the Website have the statutory right to withdraw from the distance contract within fourteen (14) calendar days without giving a reason, subject to the conditions and statutory exceptions provided by applicable law.
For goods, the withdrawal period generally begins on the day on which the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods.
Detailed information concerning the withdrawal period, procedure, condition of returned goods, statutory exceptions, return shipping costs and refunds is contained in our Return and Refund Policy, which forms part of these Terms.
RETURN SHIPPING COSTS
Where a consumer exercises the statutory right of withdrawal, including because of a change of mind or preference concerning size, colour or style, the customer bears the direct cost of returning the goods to TEPHRA.
TEPHRA does not provide or reimburse return shipping costs in such cases unless expressly agreed otherwise.
This does not apply where goods are defective, incorrect or otherwise non-conforming and applicable law requires TEPHRA to bear the relevant costs.
REFUNDS FOLLOWING WITHDRAWAL
Where an entire order is validly returned under the statutory right of withdrawal, TEPHRA will reimburse the price of the returned goods together with the original delivery charge up to the cost of the least expensive standard delivery method offered by TEPHRA for that order.
Any additional amount resulting from the customer's choice of a more expensive delivery method is not refundable where permitted by applicable law.
The direct cost of returning the goods to TEPHRA remains the responsibility of the customer in a standard withdrawal.
Where only part of an order is returned, the original delivery charge will not be refunded where that delivery charge would have remained the same for the products retained, except where applicable law requires otherwise.

EXCHANGES
TEPHRA does not offer direct exchanges for online purchases unless expressly agreed otherwise.
If you wish to purchase a different size, colour, style or product, you should place a new order and return the original item in accordance with our Return and Refund Policy.
The customer bears the direct cost of returning the original product and any delivery charge applicable to the new order.
This does not apply where the original product is defective, incorrect or otherwise non-conforming and applicable law provides otherwise.
DEFECTIVE OR NON-CONFORMING GOODS
Goods sold to consumers are covered by the statutory legal guarantee of conformity provided under applicable Greek and European Union consumer law.
Where goods do not conform to the sales contract, consumers are entitled to the remedies provided by applicable law.
Depending on the circumstances and applicable statutory requirements, these remedies may include bringing the goods into conformity through repair or replacement and, where the relevant legal conditions are satisfied, a proportionate reduction in price or termination of the contract and reimbursement.
Any remedy that applicable law requires to be provided free of charge will be provided without cost to the consumer.
These statutory rights are separate from the fourteen-day statutory right of withdrawal.
HYGIENE-SENSITIVE AND PERSONALISED PRODUCTS
The statutory right of withdrawal does not apply where an exception provided by applicable consumer law applies.
Goods made to the consumer's specifications or clearly personalised may be excluded from the statutory right of withdrawal.
Sealed goods that are not suitable for return for reasons of health protection or hygiene may also be excluded once they have been unsealed after delivery.
Where underwear, lingerie, swimwear or similar hygiene-sensitive goods are supplied with a hygiene seal, protective sticker or equivalent protective element, the statutory hygiene exception may apply once that seal or protective element has been removed, broken or otherwise compromised after delivery.
These exclusions do not restrict statutory rights concerning defective or non-conforming goods.
SALE AND PROMOTIONAL PRODUCTS
Products purchased at a reduced, promotional or sale price remain subject to the statutory right of withdrawal where that right applies.
The fact that a product is discounted does not by itself make the product non-returnable.
The same statutory exceptions and return conditions described in our Return and Refund Policy apply.
INTERNATIONAL ORDERS
Orders delivered outside the European Union may be subject to customs duties, import taxes, brokerage charges, customs-clearance fees or other charges imposed in the destination country.
Unless such charges are expressly included and collected by TEPHRA during checkout, they are the responsibility of the recipient.
TEPHRA does not control charges independently imposed by customs authorities, carriers or other authorities in the destination country.
Customs duties, import taxes and similar charges paid directly by the customer to third parties are not refundable by TEPHRA, except where applicable law expressly requires otherwise.
INTELLECTUAL PROPERTY
All content made available through the Website, including trademarks, trade names, logos, photographs, graphics, text, designs, layouts, videos and other material, is owned by TEPHRA, its licensors, the respective brands or other rights holders, as applicable, and is protected by Greek, European Union and international intellectual property laws.
Use of the Website does not transfer any intellectual property rights to the user.
Content may not be reproduced, distributed, modified, published, transmitted, commercially exploited or otherwise used without the prior authorisation of the relevant rights holder, except where expressly permitted by applicable law.
THIRD-PARTY SERVICES AND LINKS
The Website may contain links to, integrations with or functionality provided by independent third parties.
TEPHRA is not responsible for the content, availability, privacy practices or independent actions of third-party websites or services.
Use of independent third-party services may be subject to their own terms and privacy policies.
WEBSITE AVAILABILITY AND SECURITY
TEPHRA takes reasonable measures to maintain the availability and security of the Website.
Access may occasionally be interrupted because of maintenance, technical issues, updates, telecommunications failures or circumstances outside our reasonable control.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, TEPHRA will not be liable for indirect or consequential losses arising solely from circumstances for which TEPHRA is not legally responsible.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence, death or personal injury where such liability cannot legally be excluded, or any mandatory consumer right or other liability that cannot be excluded or limited under applicable law.
FORCE MAJEURE
TEPHRA will not be responsible for failure or delay in performing an obligation to the extent that the failure or delay results from circumstances outside its reasonable control.
Such circumstances may include natural disasters, severe weather, fire, war, civil disturbance, government measures, significant disruption of transport or telecommunications infrastructure or other comparable events beyond reasonable control.
Nothing in this section removes any mandatory consumer right arising under applicable law.
ELECTRONIC COMMUNICATIONS
When you place an order or otherwise transact with TEPHRA electronically, communications relating to the transaction may be provided electronically, including order confirmations, payment information, delivery updates, invoices or receipts where legally permitted, and other service communications.
Marketing communications are governed separately by our Privacy Policy and applicable consent requirements.
PRIVACY AND PERSONAL DATA
Personal data is processed in accordance with our Privacy Policy and applicable data protection legislation, including the General Data Protection Regulation (EU) 2016/679 and applicable Greek data protection legislation.
CHANGES TO THESE TERMS
TEPHRA may update these Terms where reasonably necessary to reflect changes to the Website, Services, business operations, policies or applicable law.
Updated Terms will be published on the Website and will apply from their effective date.
Changes will not retroactively alter the contractual terms applicable to an order already concluded where doing so would adversely affect mandatory or acquired consumer rights.
SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the extent necessary under applicable law and the remaining provisions will continue in effect.
NO WAIVER
Failure by TEPHRA to exercise or enforce a contractual right does not constitute a waiver of that right.

If you have a complaint concerning an order or the Services, please contact TEPHRA using the contact details provided below so that we can review the matter.
Nothing in this section limits any right to seek assistance from a competent consumer protection authority, supervisory authority, alternative dispute resolution body where applicable, or a competent court.
GOVERNING LAW AND CONSUMER RIGHTS
These Terms and purchases made through the Website are governed by Greek law.
If you are a consumer residing in another European Union or European Economic Area country, you retain any mandatory consumer protection rights granted to you under applicable European Union conflict-of-law rules.
Nothing in these Terms deprives a consumer of the protection of mandatory provisions that cannot lawfully be derogated from by agreement.
Any provision concerning jurisdiction applies only to the extent permitted by applicable consumer law.
RELATIONSHIP WITH OTHER POLICIES
These Terms should be read together with the Return and Refund Policy, Shipping Policy and Privacy Policy published on www.thetephra.com.
In relation to withdrawals, returns and refunds, the Return and Refund Policy provides the detailed applicable procedure, subject always to mandatory consumer law.
In relation to shipping and delivery, the Shipping Policy applies.
In relation to the processing of personal data, the Privacy Policy applies.
Where any provision of these Terms or another Website policy conflicts with a mandatory provision of applicable law, the mandatory legal provision will prevail.
